350 Mental Health Act Level 1

The Mental Health Act 1983 provides for the detention of people in hospital for assessment and/or treatment of mental disorder (whether they have capacity or not).

It also provides a framework for community treatment and guardianship.

There are no age restrictions which means there is no minimum age to be sectioned under the MHA.

A person must be 16 or over for Guardianship.
