Patients' Right to Be Seen in 18 Weeks: The NHS constitution states that patients have the right to access certain services commissioned by NHS bodies within maximum waiting times. If this is not possible, the NHS must take all reasonable steps to offer a range of suitable alternative providers.
NHS Choice Framework: Patients have a legal right to a choice of provider at referral for their first outpatient appointment, which could include diagnostics. While choice can be offered at various points later in the pathway, it is not a legal requirement
