Managers of POCT should be aware of their responsibility for clinical governance1,2 and of the medico-legal implications of an erroneous result.
Liability under the Consumer Protection Act (1978)3 will only remain with the manufacturer or supplier if the user can demonstrate that POCT equipment has been used in strict accordance with the manufacturer’s instructions.
Only staff whose training and competence has been established and recorded should be permitted to carry out POCT4. Each qualified user is responsible for the results they produce.
Untrained operators risk their professional registration if they use a device they are not trained and competent to use.
