Mersey Care Deprivation of Liberty Safeguards (DoLS) Level 1

On 1 April 2009 the Mental Capacity Act was amended to include the DoLS.

The DoLS are a framework for authorising a deprivation of liberty, in a hospital or care home, of a person who lacks capacity and where it is in their best interests.

Deprivation of liberty in other settings needs to be authorised by other legislation or the Court.

The aim of the DoLS is to provide protection to vulnerable people who lack the capacity to make decisions about being accommodated in hospital (or a care home) for the purpose of receiving care or treatment.
